Hello everyone, I'll need to attempt to be discreet as this matter may end up in litigation, but I was hoping some of you may have come across or heard about a similar issue.

So when I bought my Mustang from a Toronto area dealer, I traded in my car to Ford. Over a week later they email me saying they have a problem with the odometer/speedometer is not working on my trade in. As far as I know, it was working when they got it. They say they never even test drove it. Now they are trying to get me to pay an extra $$$ or take me to small claims court. Say they have to sell it mileage unknown. Any opinions? Nothing really said they bought it "as is" and they have not produced any evidence to me it is broken, or what it truly costs to fix etc.

Are Trade Ins considered sold "AS IS"

Any suggestions what steps I should take?
Call the APA? Not sure if they handle this sort of thing.
Anyone know a lawyer with Automobile experience?

I have time and money to fight them,The amount would be considered small claims court, but the amount suggested in not in writing at this point. I just hate wasting my time and money. Just feeling like it is extortion and they are trying to rip me off. If we came to a fair amount, I would still feel uncomfortable that it would be finished with and wonder who else will come after me. It feels like a way to get more money out of me.

I think the thing you would need to prove was that the odometer was working when you traded it in? Most dealerships will inspect a trade and even take it for a spin before making you an offer. Best thing to do or how to proceed might be to ask the Ontario Provincial Government regulator at the following link;

Also, look on your Bill of Sale. Probably on the reverse it will spell out the details and responsibilities regarding you and your trade in.
Did they really not look at or drive and appraise your trade in???? In all my dealings I never had that happen.

If they're too stupid to check out the trade in any closer before signing on the dotted line, they deserve to eat it. Using threats and intimidation to try and recover money they shouldn't of paid sounds like a salesman protecting his paycheque, which I get, but again, it's buyer beware, and they should know better. Not your responsibility to pay for their screw up, tell them to G.F.T. Welcome, congrats on the new ride - you haven't seen Don Edwards around the GTA have you? Fitz has been looking for him.

In Alberta there really is no protection for the dealer unless the customer has been fraudulent, I assume Ontario is much the same. Unless they are trying to say that you "rolled back" the odometer there really isn't much they can do. Check your bill of sale. If your trade in shows on the bill of sale, it should show the current mileage. If it does then the mileage must have showed when you brought it in.

Thanks so much for your replies, I prefer to give as little detail as possible for now as I don't know where this is going. Last conversation was a week ago and they were supposed to send something, but I have yet to receive it. I was advised to limit contact as this may just go away.

I'll bring it up again if it isn't over.
