I couldn't accept the answers I was getting and went and asked Ford directly about the speed limiter question. Below is the response, in it's entirety and it's not because of the driveshaft. Remember that this is for the 2012 Mustang V6 only as I was not concerned with any other model. Anyway here it is.

According to our research it would not be possible to adjust the mechanism of the seat lock. We have documented your feedback regarding the difficulties that it presents.

Regarding the speed limiters, they can be used to limit the top speed for vehicles and for some classes of vehicle; such devices are a legal requirement. Many performance cars are limited to a speed of 250 kilometers per hour or lower to limit insurance costs of the vehicle, and reduce the risk of tires failing.

^^ with all that being said, there most definitely is still an issue with the driveshafts on the V6's failing at high speeds. Maybe Ford doesn't recognize the issue, but it exists.

^^ I'm SURE Ford knows it. It's just easier to say they have to limit speed due to inurance requirements than say "our sports car will break if you try to set a land speed record". LOL Nothing wrong with that though, not too many V6's are designed to go over 250 kilometers per hour anyways. ;)
